2. Purpose

These Terms & Conditions of Sale and Use (the “Terms”) govern access to and use of the VOGG website and purchases of products sold by MGTC ENTERPRISES FZ-LLC under the VOGG brand.

These Terms apply to orders placed through the various international versions of the VOGG website, subject to any mandatory consumer protection laws applicable to the customer.

By placing an order, the customer agrees to these Terms in accordance with applicable law.

3. Legal Capacity

The customer represents that they have the legal capacity required to enter into a contract and make purchases through the website.

Where a purchase is made on behalf of another person or organization, the person placing the order represents that they are authorized to act on its behalf.

4. VOGG Products

VOGG sells sonic electric toothbrushes, accessories and other oral-care products.

Customers should review all available specifications, precautions and instructions before purchasing and using a product.

Photographs, videos, animations and 3D renderings are intended to represent products as accurately as reasonably possible. Minor differences may occur due to lighting, photography, manufacturing variations or display settings.

5. VOGG Bundles

VOGG may offer various product bundles, including:

The exact contents and price of each bundle are those displayed on the applicable product page when the order is placed.

Only the price displayed on the website at the time the order is placed applies to the purchase.

6. Colors and Variants

Certain VOGG products are available in different colors or variants.

Where a bundle contains multiple toothbrushes, customers may be asked to select the color of each toothbrush individually.

Customers are responsible for reviewing their selections before confirming the order.

7. Product Availability

All products are offered subject to availability.

If a product becomes unavailable after an order has been placed, VOGG may offer the customer the option to wait for restocking, accept an alternative solution or receive a refund for the unavailable product.

In the event of an obvious pricing error resulting from a technical malfunction, data-entry error or similar issue, VOGG may contact the customer to explain the error and propose an appropriate solution in accordance with applicable law.

10. Promotions

VOGG may offer promotions, discounts, gifts, promotional codes or special offers.

Specific terms applicable to an offer will be disclosed with that offer.

Unless otherwise stated, promotional codes may not be combined.

Fraudulent or abusive use may be rejected.

11. Orders

Customers select the products, variants and quantities they wish to purchase.

Before submitting payment, customers have an opportunity to review the essential details of their order and correct errors.

Customers must provide accurate and sufficiently complete information to allow VOGG to process payment and delivery.

12. Order Confirmation

After an order is successfully submitted, the customer will normally receive an electronic confirmation.

13. Refusal or Cancellation

VOGG may refuse or cancel an order for a legitimate reason, including suspected fraud, misuse of a payment method, clearly inaccurate information, product unavailability, an obvious pricing error or a legal or practical inability to fulfill the order.

Where a paid order is cancelled and no product is supplied, the corresponding amount will be refunded in accordance with applicable law.

Payments may be processed through Shopify Payments and/or other payment service providers available through the website.

VOGG does not necessarily directly receive or store all customer banking or payment card information.

VOGG ships to the countries and territories available when an order is placed.

Available shipping methods, charges and estimated delivery times are displayed on the website or during checkout.

Customers are responsible for providing an accurate delivery address.

Delivery times are estimates unless expressly stated otherwise.

17. Delivery Delays

Delivery delays may occur due to carrier delays, customs procedures, adverse weather, unusually high order volumes or circumstances outside VOGG's reasonable control.

Nothing in this section limits mandatory consumer rights.

18. 30-Day Change-of-Mind Return Policy

In addition to applicable statutory rights, VOGG provides a commercial return policy allowing eligible products to be returned within 30 days of receipt.

19. Condition of Returned Products

For a change-of-mind return, the product must be unused, complete, in its original condition and, where reasonably possible, returned with its original packaging and accessories.

Sealed products that have been unsealed and cannot reasonably be returned for health protection or hygiene reasons may be excluded where permitted by applicable law.

This does not affect rights relating to defective, damaged or non-conforming products.

20. Return Shipping Paid by VOGG

When a return is approved under VOGG's 30-day return policy, VOGG will cover the return shipping costs in accordance with the return procedure provided by Customer Support.

Customers must contact VOGG before returning a product.

VOGG does not guarantee reimbursement of shipping expenses independently incurred outside the provided return procedure.

21. Refunds

After receiving and inspecting the returned product, VOGG will issue a refund where the applicable conditions are satisfied.

Where reasonably possible and subject to applicable law, refunds will be made to the original payment method.

22. Statutory Right of Withdrawal — France and European Union

For customers entitled to a statutory right of withdrawal under French or European Union law, these Terms do not reduce those statutory rights.

Consumers purchasing online in France generally benefit from a 14-day statutory withdrawal period, subject to applicable exceptions.

VOGG's commercial 30-day return policy provides an additional benefit and does not reduce statutory rights.

23. VOGG 2-Year Commercial Warranty

VOGG provides a 2-year commercial warranty on products for which this warranty is expressly offered.

The warranty covers qualifying manufacturing defects and malfunctions arising during normal use.

24. Commercial Warranty Exclusions

Unless mandatory law provides otherwise, the commercial warranty does not cover normal wear and tear, consumable components worn through normal use, misuse, accidental damage, unauthorized modifications or use contrary to product instructions.

These exclusions do not restrict statutory rights.

25. Statutory Warranties

VOGG's commercial warranty is provided in addition to and does not replace applicable statutory warranties or consumer rights.

For French consumers, the statutory guarantee of conformity may generally be exercised for two years from delivery, subject to the conditions established by applicable law.

27. Hygiene Products and Toothbrush Heads

Toothbrush heads and other products intended to come into direct contact with the mouth are hygiene products.

Returns after opening or use may be excluded where applicable law permits such a restriction.

Rights relating to defective or non-conforming products remain unaffected.

28. Replacement Head Subscriptions

VOGG offers replacement-head subscription plans.

Depending on the selected plan:

Discovery: 1 replacement head every 3 months — €4.99
Duo: 2 replacement heads every 3 months — €9.99
Family: 3 replacement heads every 3 months — €14.99

Shipping included.

The applicable price, billing frequency and delivery frequency are disclosed before enrollment.

For markets using currencies other than EUR, the applicable subscription price is the price displayed to the customer for that market before enrollment.

29. Subscription Renewal

Subscriptions automatically renew every three months until cancelled.

The payment method on file is automatically charged according to the selected plan.

If payment fails, VOGG or its payment provider may retry the payment and/or request updated payment information.

30. Subscription Changes and Cancellation

There is no minimum commitment period.

Customers may modify the applicable quantity where this option is available or cancel at any time, provided cancellation occurs before the next order is processed.

VOGG subscriptions do not include a pause or skip option.

31. Contests and Promotional Activities

VOGG may offer contests, prize wheels, sweepstakes, giveaways or other promotional activities.

Separate terms may specify duration, eligible territories, participation requirements, prizes and restrictions.

32. Product Use

VOGG products must be used in accordance with the instructions provided.

Oral-health information on the website is for general informational purposes and is not a substitute for personalized advice from a qualified healthcare professional.

33. Intellectual Property

The VOGG website and its content, including text, photographs, videos, graphics, logos, animations, interfaces and designs, are protected by applicable intellectual property laws.

The VOGG name, logo and visual identity may not be reproduced or commercially exploited without authorization where legally required.

34. Customer Reviews

Reviews must reflect genuine experiences.

VOGG may moderate unlawful, fraudulent, defamatory, abusive or intentionally misleading content in accordance with applicable rules.

35. User-Generated Content

Where customers or creators provide photographs, videos, testimonials or other content to VOGG, commercial use of such content is subject to the permissions and rights granted under the applicable agreement or authorization.

Submission alone does not necessarily constitute an unlimited transfer of intellectual property rights.

36. Liability

VOGG and MGTC ENTERPRISES FZ-LLC make reasonable efforts to provide conforming products and maintain the proper operation of the website.

These Terms and sales made by MGTC ENTERPRISES FZ-LLC are governed by the laws applicable in the United Arab Emirates and, where applicable, to the company's activities in the Ras Al Khaimah free zone, without prejudice to any mandatory consumer protection laws applicable to the customer.

Where a consumer benefits from mandatory protections in their country or state of residence that legally apply to the transaction, nothing in these Terms is intended to deprive the consumer of those protections.

42. Customers Located in the United Arab Emirates

Orders to customers located in the UAE remain subject to mandatory legal requirements applicable to the transaction.

Nothing in these Terms excludes or limits mandatory consumer rights.

For customers located in the United States, consumer rights may vary depending on applicable federal and state law.

46. Severability

If any provision is determined to be invalid, unlawful or unenforceable, that determination will not necessarily affect the validity or enforceability of the remaining provisions to the extent permitted by law.
